Shipping policy
1. Definitions
1.1 "Digital Product" means any intangible good or service delivered electronically, including but not limited to software, e-books, templates, media files, or subscription-based content.
1.2 "Physical Product" refers to any tangible item requiring shipment.
1.3 "Delivery" is deemed complete for:
- Digital Products: Upon transmission of download instructions or access credentials to the Customer’s provided email or account dashboard.
- Physical Products: When the carrier provides tracking confirmation (FOB Shipping Point).
2. Digital Product Delivery Terms
2.1 Instant Access
- Digital Products are available for download in 24 hours upon completed payment.
- The Customer is solely responsible for:
- Ensuring compatibility with their systems.
- Maintaining backup copies; no re-download guarantees are provided.
2.2 No Shipping Involvement
- Digital Products do not require physical shipment. Any claims of "non-delivery" must be resolved via the Seller’s support system within 7 days of purchase.
3. Physical Product Shipping Terms
3.1 Variable Shipping Arrangements
- Shipping costs, timelines, and methods for Physical Products are not included in the base price unless explicitly stated.
- Customers must contact Seller prior to purchase to:
- Confirm shipping fees (which may vary by location, weight, and carrier).
- Discuss expedited or insured shipping options (if available).
3.2 Risk of Loss
- Title and risk of loss pass to the Customer upon handoff to the carrier.
- Seller is not liable for:
- Delays caused by carriers, customs, or force majeure events.
- Damage during transit (claims must be filed by Customer with the carrier).
4. Customer Obligations
4.1 Accurate Information
- Customers must provide:
- A valid email for Digital Products.
- Correct shipping address for Physical Products; errors may result in additional fees or lost items.
4.2 Timely Action
- For Digital Products: Download promptly; access links may expire within 14 days.
- For Physical Products: Respond within 48 hours to shipping inquiries.
5. No Return/Refund Differentiation
5.1 Digital Products: All sales are final (see Section 2.1).
5.2 Physical Products: Return eligibility (if any) will be specified case-by-case during shipping discussions.
6. Global Compliance & Liability
6.1 Jurisdictional Variance
- Physical Product shipping may be restricted to certain countries due to:
- Export controls (e.g., ITAR, EAR).
- Local customs regulations (additional duties are Customer’s responsibility).
6.2 Force Majeure
- Seller is excused from delays caused by:
- Natural disasters.
- Governmental actions.
- Supply chain disruptions.
Enforcement Clauses
- Digital Default: Failure to download does not constitute non-delivery.
- Physical Product Disputes: Must be reported within 5 business days of tracking-confirmed delivery.
- Governing Law: Disputes subject to Goa, Panjim, India laws.
